Africa Maritime Services reserves the right to pursue all available legal remedies against any person or entity that violates these Terms.
Article 01

Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Africa Maritime Services SARL ("AMS," "we," "us," or "our"), a company incorporated and operating under the laws of the Republic of Djibouti, with its registered head office at Cité Dawaleh, Djibouti City.

By accessing, browsing, or otherwise using the website located at www.africamaritimeservices.com (the "Site"), or any of its subpages, you acknowledge that you have read, understood, and expressly agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you are accessing the Site on behalf of a company or other legal entity, you represent and warrant that you have full authority to bind that entity to these Terms, and all references to "you" shall refer to both you individually and such entity.

Minimum Age: By using this Site you confirm that you are at least 18 years of age, or the legal age of majority in your jurisdiction, whichever is higher.
Article 02

Site Access & Permitted Use

AMS grants you a limited, non-exclusive, non-transferable, revocable licence to access and use this Site solely for lawful purposes and strictly in accordance with these Terms.

Permitted uses include:

  • Browsing publicly available information about AMS services, fleet, and operations for personal or legitimate business research purposes.
  • Submitting genuine, good-faith inquiries through the official contact form.
  • Accessing and downloading publicly available documents expressly made available for download by AMS.
  • Sharing links to publicly accessible pages of the Site, provided such sharing does not misrepresent AMS or its services.

Any use of the Site outside the scope described above is strictly prohibited and may constitute a violation of applicable law.

Article 03

Prohibited Uses

You agree that you will not, under any circumstances, engage in any of the following activities. Violations may result in immediate termination of access, civil claims for damages, and criminal prosecution to the full extent permitted by applicable law.

Strictly Forbidden Conduct
  • Using the Site, its forms, or any communication channel for spam, unsolicited bulk messages, phishing, or any fraudulent communication.
  • Impersonating AMS, its employees, partners, or agents — in any context, online or offline.
  • Submitting false, misleading, or fictitious service inquiries, quotation requests, or contact form entries with the intent to waste AMS resources or disrupt operations.
  • Attempting to gain unauthorized access to any part of the Site, its servers, databases, or connected systems.
  • Uploading, transmitting, or distributing any virus, worm, Trojan horse, spyware, ransomware, or any other malicious code through or targeting the Site.
  • Using automated scripts, bots, crawlers, or any non-human agents to interact with the Site's forms, contact mechanisms, or interactive features.
  • Scraping, harvesting, or extracting data from the Site by any technical means — automated or manual — for redistribution, commercial use, or competitive intelligence purposes.
  • Circumventing, disabling, or otherwise interfering with security features of the Site, including any rate limiting, CAPTCHA, or access control mechanism.
  • Using the Site or any information obtained from it to facilitate any illegal, discriminatory, or harmful activity against AMS, its clients, partners, or employees.
  • Attempting to reverse-engineer, decompile, or disassemble any software or technology used to operate the Site.
  • Framing, mirroring, or republishing any part of the Site without prior written authorization from AMS.
  • Using the Site for competitive intelligence gathering, price surveillance, or to benefit any direct or indirect competitor of AMS without explicit written consent.
  • Taking any action that places a disproportionate or unreasonable load on the Site's infrastructure, including but not limited to distributed denial-of-service (DDoS) attacks.
  • Engaging in any conduct that AMS, in its sole discretion, determines to be harmful to the Site, its users, its reputation, or its commercial interests.
Article 04

No Scraping or Automated Access

The systematic or automated retrieval of content from this Site — including but not limited to web scraping, crawling, spidering, indexing by unauthorized third parties, or any similar data extraction technique — is expressly prohibited without the prior written consent of AMS.

This prohibition applies regardless of the technical method used, whether through scripts, bots, AI agents, browser automation tools (e.g. Selenium, Playwright), API wrappers, or any other mechanism that accesses the Site at a frequency or volume exceeding normal individual human browsing behaviour.

Exception for Search Engines: Legitimate search engine crawlers (e.g. Googlebot, Bingbot) operating in compliance with our robots.txt directives are permitted. All other automated access requires prior written authorization.

Violation of this article constitutes a breach of these Terms and may additionally constitute an infringement of applicable intellectual property law, computer fraud legislation, and data protection regulations. AMS reserves the right to pursue injunctive relief and monetary damages against violators.

Article 05

Contact Form & Service Inquiries

The contact and quotation form on this Site is provided exclusively for genuine, good-faith commercial inquiries from individuals and organizations with a legitimate interest in AMS services.

By submitting an inquiry you represent and warrant that:

  • You are submitting on behalf of yourself or an organization you are authorized to represent.
  • All information you provide is accurate, truthful, and not misleading.
  • Your inquiry is genuine and you intend to act upon any response provided by AMS.
  • You are not submitting the form to harvest contact details, conduct competitive research, test AMS's response protocols, or for any other non-genuine purpose.
  • You are not using automated tools, bots, or scripts to submit the form.

AMS reserves the right to discard, block, or take legal action in response to any submission that it reasonably suspects to be false, malicious, repetitive, or submitted in bad faith. Submitting false commercial inquiries may constitute fraud under Djiboutian law and other applicable jurisdictions.

Article 06

Intellectual Property

All content published on this Site — including but not limited to the AMS name and logo, vessel names, design elements, photographs, graphics, text, layout, source code, and the overall look and feel of the Site — is the exclusive property of Africa Maritime Services SARL or its licensors, and is protected by Djiboutian and international intellectual property laws.

You are expressly prohibited from:

  • Copying, reproducing, republishing, uploading, posting, transmitting, or distributing any Site content without prior written permission from AMS.
  • Using the AMS name, logo, or any associated trademarks — in any form, medium, or context — without explicit written authorisation.
  • Creating derivative works based on content found on this Site.
  • Removing or altering any copyright, trademark, or other proprietary notices on Site content.

Any authorized use of AMS intellectual property must include appropriate attribution and must not suggest endorsement or partnership where none exists.

Article 07

Confidentiality of Commercial Information

Any rates, pricing information, cargo specifications, logistics routes, vessel schedules, or other commercially sensitive information communicated to you by AMS — whether through the Site, email, phone, or any other channel — is strictly confidential and provided solely for the purpose of the specific commercial inquiry to which it relates.

You agree that you will not:

  • Disclose any such information to third parties without prior written consent from AMS.
  • Use commercially sensitive AMS information for competitive benchmarking, market analysis, or for the benefit of any competitor of AMS.
  • Publish or make publicly available any quotation, pricing breakdown, or logistics proposal provided by AMS.

This confidentiality obligation survives the termination of any commercial relationship or inquiry process and shall remain in force indefinitely unless expressly waived in writing by AMS.

Article 08

Disclaimer & Limitation of Liability

This Site and all content thereon is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied. AMS makes no representation or warranty that the Site will be uninterrupted, error-free, or free from viruses or other harmful components.

To the maximum extent permitted by applicable law, AMS shall not be liable for:

  • Any direct, indirect, incidental, consequential, or punitive damages arising from your use of or inability to use this Site.
  • Any loss of data, profits, revenue, business, or goodwill resulting from access to or reliance on content published on this Site.
  • Errors, inaccuracies, or omissions in any Site content, including but not limited to operational schedules, fleet data, or service descriptions.
  • Unauthorized access to or alteration of your transmissions or data by third parties.

Nothing in these Terms limits AMS's liability for fraud, willful misconduct, or any liability that cannot be excluded or limited by applicable law.

Note: The content on this Site is for general informational purposes only and does not constitute a binding commercial offer. All services are subject to a separate written agreement between AMS and the contracting party.
Article 09

Suspension & Termination of Access

AMS reserves the right, at its sole and absolute discretion, to suspend, restrict, or permanently terminate your access to all or any part of this Site at any time, with or without notice and without liability to you, if AMS reasonably believes that you have:

  • Violated any provision of these Terms.
  • Engaged in conduct that is harmful, fraudulent, or disruptive to AMS, its employees, clients, or partners.
  • Submitted false or misleading information to AMS through any channel.
  • Attempted to circumvent any technical protection measure on the Site.
  • Acted in a manner inconsistent with the good-faith use of a professional maritime services platform.

Termination does not limit any other remedies available to AMS, including legal proceedings. All provisions of these Terms that by their nature should survive termination — including intellectual property rights, confidentiality, limitation of liability, and governing law — shall survive.

Article 10

Enforcement & Legal Remedies

AMS takes the security, integrity, and reputation of its digital presence seriously. Any violation of these Terms may expose the violating party to, without limitation:

  • Immediate and permanent blocking of all access to the Site from relevant IP addresses, devices, and networks.
  • Civil claims for damages, including economic loss, reputational damage, and costs incurred as a result of the violation.
  • Injunctive relief to prevent ongoing or threatened violations.
  • Referral to relevant law enforcement authorities in Djibouti and/or the violating party's jurisdiction.
  • Public disclosure of the violation to the extent permitted by applicable law, where such disclosure serves a legitimate interest in protecting AMS clients or partners.

AMS actively monitors usage patterns of this Site and employs technical measures to detect and record unauthorized access, scraping, and abuse. Log data, IP addresses, submission records, and access timestamps may be retained and used as evidence in legal proceedings.

Zero Tolerance Policy: AMS operates a zero-tolerance policy with respect to fraudulent inquiries, impersonation, system abuse, and intellectual property theft. We will not hesitate to exercise our full legal rights.
Article 11

Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Djibouti, without regard to its conflict of law principles.

Any dispute, controversy, or claim arising out of or in connection with these Terms, or the breach, termination, or invalidity thereof, shall be subject to the exclusive jurisdiction of the competent courts of Djibouti City, Republic of Djibouti.

Notwithstanding the above, AMS reserves the right to seek injunctive relief or other equitable remedies in any jurisdiction where a violation of these Terms is occurring or threatens to occur, without prejudice to its right to bring substantive proceedings in Djibouti.

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Article 12

Changes to These Terms

AMS reserves the right to modify, update, or replace these Terms at any time at its sole discretion. Changes will be published on this page with an updated "Last Updated" date. Material changes may additionally be communicated via the Site's homepage or through direct communication where appropriate.

Your continued use of the Site following publication of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must immediately discontinue your use of the Site.
